Dharohar Arts

Terms and Conditions

1. About Us

Welcome to Dharohar Arts. These Terms and Conditions ("Terms") govern your use of our website [dharohararts.com] (the "Site") and your purchase of products and services from us, including framed heritage wall art, exhibition attendance, and related services (together, the "Services").

Dharohar Arts is a UK company headquartered in Leicester, England, dedicated to celebrating India's traditional heritage arts. We work in partnership with artisan communities and organisations in India to source, produce and export limited-edition artworks, and to host exhibitions celebrating Indian heritage art.

By accessing or using our Site, placing an order, or attending one of our exhibitions, you agree to be bound by these Terms. If you do not agree, please do not use our Services.

2. Eligibility

You must be at least 18 years old, or have the consent of a parent or guardian, to place an order or create an account with us. By using our Services, you confirm you meet this requirement.

3. Our Products

3.1 Nature of the artwork

Our products are limited-edition heritage wall art created by traditional Indian artisans, using techniques such as Sanjhi, Gond, Madhubani, Phad, Rogan, and others. Because each piece is handmade with traditional processes, minor variations in colour, texture and finish between the images on our Site and the piece you receive are normal and are not defects.

3.2 Product descriptions

We make every effort to describe our products, materials, and cultural background accurately. Colours may appear slightly different depending on your screen. We reserve the right to correct errors in descriptions, pricing or availability, and to update, discontinue or limit availability of any product at any time.

4. Prices and Payment

  • All prices are shown in [GBP £], inclusive/exclusive of VAT as indicated at checkout.

  • For international orders, you are responsible for any customs duties, import taxes or fees charged by your local authorities on delivery; these are not included in our prices unless stated otherwise.

  • Payment is processed securely through our third-party payment provider at the time of order. We may refuse or cancel an order at our discretion, including for suspected fraud, pricing errors, or unavailability of stock.

  • We may change prices at any time, but this will not affect orders you have already placed and had confirmed.

5. Orders and Order Acceptance

  • Placing an order through our Site is an offer to purchase, which we may accept or decline.

  • A contract between you and us is only formed once we send an order confirmation email accepting your order.

  • As many of our pieces are limited-edition or one-of-a-kind, we reserve the right to cancel an order, with a full refund, if the item becomes unavailable after you order it.

6. Shipping and Delivery

  • We ship worldwide. Estimated delivery times shown at checkout are indicative and may vary due to customs processing, especially for international shipments.

  • Risk in the artwork passes to you on delivery. Ownership passes to you once we have received payment in full.

  • Artworks are carefully packed by our export partners to minimise the risk of damage in transit. If your artwork arrives damaged, contact us within [7] days of delivery, with photographs, so we can arrange a replacement, repair or refund.

7. Cancellations, Returns and Refunds

7.1 Right to cancel (UK/EU consumers)

If you are a consumer ordering from the UK or EU, you generally have the right to cancel your order within 14 days of receiving it, without giving a reason, under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013. To exercise this right, contact us within 14 days of delivery.

7.2 Exceptions

Because many of our pieces are bespoke, personalised, or made to order, this cancellation right may not apply to items specifically customised at your request (for example, artworks personalised with your name, or bespoke commissions), as permitted under the Regulations.

7.3 Condition of returns

Items must be returned unused, undamaged, and in their original packaging where possible. You are responsible for return shipping costs unless the item is faulty, damaged in transit, or not as described.

7.4 Refunds

Once we receive and inspect a valid return, we will issue a refund to your original payment method within 14 days.

7.5 Faulty or damaged goods

If your artwork is faulty, damaged, or significantly not as described, you are entitled to a repair, replacement or refund under the Consumer Rights Act 2015 (for UK consumers) or equivalent local consumer protection law.

8. Exhibitions and Events

  • From time to time, we host or take part in exhibitions and cultural events in the UK and elsewhere. Attendance may be subject to separate event-specific terms (e.g. ticketing, RSVP, or venue rules), communicated at the time of registration.

  • We reserve the right to change the date, time, venue or format of an exhibition, or to cancel it, for reasons outside our reasonable control.

9. Intellectual Property

  • All content on our Site, including text, images, artwork, photography, logos, the "Dharohar Arts" name and branding, and cultural/story content, is owned by us or licensed to us, and is protected by copyright, trademark and other intellectual property laws.

  • The artworks themselves, and the traditional art forms they represent, embody the cultural heritage and skill of the artisans and communities who created them. We are committed to fairly attributing and compensating artisans for their work, in partnership with Tri-Impact Global.

  • You may not reproduce, copy, distribute or exploit any content from our Site for commercial purposes without our prior written permission.

10. Accounts

  • If you create an account with us, you are responsible for keeping your login details confidential and for all activity under your account.

  • You agree to provide accurate, current information and to notify us of any unauthorised use of your account.

11. Acceptable Use

You agree not to use our Site to:

  • Violate any applicable law or regulation

  • Infringe our intellectual property, or that of any third party

  • Submit false, misleading or fraudulent information

We reserve the right to suspend or terminate access to our Services for any breach of these Terms.

You are solely responsible for ensuring your content does not infringe any third party's rights and is lawful, accurate and not offensive.

13. Third-Party Links and Tools

  • Subject to the point above, our total liability to you for any claim arising from your order or use of our Services will not exceed the amount you paid for the relevant product or service.

  • We are not liable for any indirect or consequential losses, including loss of profits, arising from your use of our Site or Services.

16. Indemnity

You agree to indemnify and hold Dharohar Arts harmless from any claims, losses or expenses (including reasonable legal fees) arising from your breach of these Terms or your misuse of our Services.

17. Force Majeure

We will not be liable for any failure or delay in performing our obligations where this results from events beyond our reasonable control, including customs delays, strikes, natural disasters, or restrictions affecting our artisan partners in India.

18. Governing Law and Jurisdiction

These Terms are governed by the laws of England and Wales. Any disputes arising from these Terms or your use of our Services are subject to the exclusive jurisdiction of the courts of England and Wales, save that consumers resident in the EU/EEA may also be entitled to bring proceedings in their own country of residence under applicable consumer protection law.

19. Changes to These Terms

We may update these Terms from time to time. The most current version will always be available on this page, and your continued use of our Site after changes are posted constitutes acceptance of the revised Terms.

20. Severability

If any provision of these Terms is found unlawful or unenforceable, the remaining provisions will remain in full force and effect.
